These terms and conditions of use (“Terms of Use”) outline what you can expect from FIS BANKING ALERTS’s text message alert service (the “Service”) from FIS BANKING ALERTS (as defined at the end of these Terms and Conditions) as well as your and FIS BANKING ALERTS’s responsibilities. Carriers are not liable for delayed or undelivered messages.

PLEASE READ CAREFULLY THE FOLLOWING ACCOUNT ALERTS TERMS OF USE BEFORE SUBSCRIBING TO THE SERVICE AS OFFERED BY FIS BANKING ALERTS (ALSO, “WE”, OR “US”). YOU AGREE TO THESE TERMS OF USE BY YOUR USE OF THE SERVICE. THESE TERMS OF USE GOVERN THE SERVICE, INCLUDING ANY UPDATES OR CHANGES THAT WE MIGHT MAKE TO THE SERVICE FROM TIME TO TIME. NOTHING CONTAINED IN THESE TERMS OF USE IS INTENDED TO MODIFY OR AMEND ANY OTHER TERMS AND CONDITIONS RELATING TO ANY OF YOUR FIS BANKING ALERTS ACCOUNTS, WHICH TERMS AND CONDITIONS ARE INCORPORATED HEREIN OR WRITTEN AGREEMENTS, IF ANY, WHICH MAY CURRENTLY BE IN EFFECT BETWEEN YOU AND FIS BANKING ALERTS. FIS BANKING ALERTS MAY PERIODICALLY MODIFY THESE TERMS OF USE, AND ANY SUCH MODIFICATIONS WILL BE EFFECTIVE IMMEDIATELY UPON POSTING THE UPDATED VERSION. BY CONTINUING TO USE THE SERVICE, YOU AGREE TO THESE MODIFICATIONS.

About the Service

FIS BANKING ALERTS is pleased to offer this Service to provide you with text message alerts for your FIS BRANDED BANKING ALERTS account(s). By subscribing to this Service you agree to receive text message alerts via the use of an automatic telephone dialing system, or autodialer. Please note that alert frequency for the Service will vary depending on the types of accounts you have, your account settings, your alert subscriptions, and your account activity..

You may also be offered to re-subscribe to specific text message alerts in the Program while processing selected transactions by agreeing to receive text message alerts to confirm appointments you may have set up with financial advisors. These Terms and Conditions cover all text message alerts originating from FIS BRANDED BANKING ALERTS. Our Service uses several short codes, which may change from time to time.

Once you subscribe to a particular type of OTP account alert, you will receive, on an ongoing basis, a text message alert every time that type of activity or transaction occurs.

FIS BANKING ALERTS does not charge for the Service; however, message and data rates may apply from your mobile carrier. By subscribing to the Service, you acknowledge that FIS BANKING ALERTS is not responsible for any such charges by your mobile carrier.

Subscribing and Unsubscribing via the FIS BANKING ALERTS Mobile App

To subscribe to the various types of alerts you can receive through the Service from the FIS BANKING ALERTS Mobile App, it maybe possible to select “Settings” and then “Communication Preferences”. IF not simply type your cell phone number in the field in the opt-in box and you will receive OPT messages for the campaign program you see on the screen. You must confirm in addition to confirming your mobile phone number that you request to receive such message alerts.

You may also be offered to subscribe to specific text message alerts in the Program while processing selected transactions by agreeing to receive text message alerts to confirm appointments you may have set up with financial advisors. These Terms and Conditions cover all text message alerts originating from FIS BANKING ALERTS. Our Service uses several short codes, which may change from time to time.

You may change your alert preferences at any time by going to “Text Messaging Preferences” from the FIS BANKING ALERTS Mobile App.

FIS BANKING ALERTS does not charge for the Service; however, message and data rates may apply from your mobile carrier. By subscribing to the Service, you acknowledge that FIS BANKING ALERTS is not responsible for any such charges by your mobile carrier.

Data obtained from you in connection with the Service may include your mobile phone number, your carrier’s name, and the date, time, and content of your messages and other information that you may provide. We may use this information to contact you and to provide the services you request from us, and to otherwise operate, develop, and improve the service. Your wireless carrier and other service providers may also collect data from your SMS usage, and their practices are governed by their own policies. We will only use the information you provide to the service to transmit your text message or as otherwise described in this document and our Privacy Notices. Nonetheless, we reserve the right at all times to disclose any information as necessary to satisfy any law, regulation, or governmental request, to avoid liability, or to protect our rights or property. When you complete forms online or otherwise provide us information in connection with the service, you agree to provide accurate, complete, and true information.

The Service, as well as the content and materials received through the Service, are proprietary to us and our licensors, and are for your personal, non-commercial use only. You shall not damage, impair, interfere with, or disrupt the service or its functionality.

Unsubscribe

To unsubscribe from the Service, you may text STOP to 76128 , “END”, “CANCEL”, “UNSUBSCRIBE”, or “QUIT” to any alert text message from FIS BANKING ALERTS.

You may also return to the Preference Center of your account and unsubscribe from the account alert message types for which you no longer wish to receive text messages.

By unsubscribing from all alert types, you will be unsubscribed from the Service. By subscribing to this Service, you agree that following any request to unsubscribe, you will receive one final text message from FIS BANKING ALERTS confirming that you have been unsubscribed from the Service.

To continue the Service, you will need to complete the subscription process again. If you update your mobile phone number through the Preference Center, FIS BANKING ALERTS will send a verification code to the updated mobile phone number you provide. You will then need to enter that verification code in order to maintain your subscription.

If you change carriers, even if your mobile phone number stays the same, or if FIS BANKING ALERTS is notified by a carrier that you have changed your mobile phone number, you will be unsubscribed from the Service.

To continue the Service, you will need to complete the subscription process again. If you update your mobile phone number through the Preference Center, FIS BANKING ALERTS will send a verification code to the updated mobile phone number you provide. You will then need to enter that verification code in order to maintain your subscription.

If you do not request any transactions or activities eligible for the Service for 18 months or more, you will be automatically unsubscribed from the Service and/or sent one final text message indicating that your subscription to the Service will be terminated. To continue the Service, you will need to complete the subscription process again.

Acknowledgements

In using the Service, you acknowledge, represent, and agree to the following:

     You are authorized to access the accounts and financial information that may be accessed or disseminated via the Service.

     All information you provide to us in connection with the Service is accurate, current, and complete, and you have the right to provide such information to us for the purpose of using the Service.

     The mobile phone number you provide to subscribe to the Service is registered in your name, and you will not initiate messages to the phone or other access device of any other person or entity.

     You will contact FIS BANKING ALERTS immediately if you become aware of any suspicious or unauthorized conduct concerning the Service or your accounts, or if you receive text messages regarding transactions or other account activity that you did not request.

     You understand that use of the Service may involve the transmission of information to you that may be considered personal financial information. You consent to the transmission of such personal financial information by electronic means.

     You assume all risk for directing FIS BANKING ALERTS to send text messages to mobile phones or other access devices that may not utilize personalized security codes or encryption.

     You understand that you are solely responsible for minimizing security risks, for example, by keeping your mobile phone or other access device under your physical control.

     You understand that the Service is also subject to termination in the event your wireless service terminates or lapses.

Currently, the Service is available only to legal residents of the United States. Furthermore, you must be 18 years of age or older to receive messages. We reserve the right to require you to prove that you are at least 18 years of age if so requested.

You may not subscribe, access, or attempt to access or use the Service from countries outside of the United States.

Carriers Supported

The Service is available on most carriers, including but not limited to: AT&T, Sprint, T-Mobile, Verizon Wireless, Alltel AWCC, Boost, Boost Unlimited, Cincinnati Bell, Cricket Communications, MetroPCS, U.S. Cellular, Google Voice, and Virgin Mobile USA. Note that T-Mobile is not liable for delayed or undelivered messages.

Miscellaneous

The laws of the State of Florida, without regard to principles of conflict of laws, govern these Terms of Use and any dispute that might arise between you and FIS BANKING ALERTS related to the Service.

FIS BANKING ALERTS reserves the right to terminate this Service, in whole or in part, at any time for any reason without notice.

Disclaimer of Warranty and Limitation of Liability

THE SERVICE IS PROVIDED AS A CONVENIENCE TO YOU FOR INFORMATION PURPOSES ONLY. THE INFORMATION THROUGH THE SERVICE IS PROVIDED ON AN “AS IS,” AND “AS AVAILABLE” BASIS. FIS BANKING ALERTS DOES NOT WARRANT THE INFORMATION PROVIDED HEREIN OR YOUR USE OF OUR SERVICE GENERALLY, EITHER EXPRESSLY OR IMPLIEDLY, FOR ANY PARTICULAR PURPOSE AND EXPRESSLY DISCLAIMS ANY IMPLIED WARRANTIES, INCLUDING BUT NOT LIMITED TO, WARRANTIES OF TITLE, NON-INFRINGEMENT, MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. FIS BANKING ALERTS WILL NOT BE RESPONSIBLE FOR ANY LOSS OR DAMAGE THAT COULD RESULT FROM INTERCEPTION BY THIRD PARTIES OF ANY INFORMATION MADE AVAILABLE TO YOU VIA OUR SERVICE. ANY FLOOD, EXTRAORDINARY WEATHER CONDITIONS, EARTHQUAKE OR OTHER ACT OF GOD, FIRE, WAR, INSURRECTION, RIOT, LABOR DISPUTE, ACCIDENT, ACTION OF GOVERNMENT, COMMUNICATIONS OR POWER FAILURE, OR EQUIPMENT OR SOFTWARE MALFUNCTION). FIS BANKING ALERTS CANNOT AND DOES NOT GUARANTEE CONTINUOUS, UNINTERRUPTED, OR SECURE MESSAGES SERVICE.

Delivery of information and content to a mobile device may fail due to circumstances or conditions beyond FIS BANKING ALERTS’s control. You understand and acknowledge that network services, including but not limited to mobile network services, are outside of FIS BANKING ALERTS’s control, and FIS BANKING ALERTS is not responsible or liable for such problems. FIS BANKING ALERTS and your carrier are not responsible for delayed or undelivered text messages.

Indemnity

You hereby agree to indemnify and hold harmless FIS BANKING ALERTS and its affiliates, subsidiaries, directors, officers, employees, agents, licensors, and any third-party information providers and vendors upon demand from and against any and all claims, losses, expenses, demands, or liabilities, including attorneys’ fees and costs, demanded of or incurred by such FIS BANKING ALERTS parties in connection with any claim by a third party (including any intellectual property claim) arising out of (i) your improper use of the Service, (ii) your violation of these Terms of Use or of any applicable law, or (iii) the infringement, misappropriation, or violation by you, or other individual using your mobile phone, password, computer, or other access device, of any intellectual property, privacy, or other right of any person. You further agree that you will cooperate fully in the defense of any such claims. FIS BANKING ALERTS reserves the right to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, and you shall not in any event settle any such claim or matter without the written consent of FIS BANKING ALERTS.

Limitation of Action

Neither you nor FIS BANKING ALERTS may bring a legal action with respect to these terms more than eighteen months after the legal action accrues.

Maximum Liability

Notwithstanding any other provision of these Terms of Use, the maximum liability of FIS BANKING ALERTS for damages hereunder shall not exceed $100.00. In states where such limitations on liability are not permitted, FIS BANKING ALERTS’s liability shall be limited to the fullest extent permitted by applicable law.

Consent and Acknowledgement

By checking the acceptance box on the registration page, you are stating that you have read and understand these Terms of Use and would like to subscribe to the Service.
